Witnesses are not necessary for a “holographic” will.

A witness may not be a “devisee” (person who inherits) under the will. The witnesses must actually witness the execution of the will. For example, someone who is physically unable to write a will could use an attending person, and that will would be valid. The “attending person” would be someone acting under the direction of the person executing the will.

The will must be “in writing and signed by the testator, or by an attending person at the testator’s express direction, and attested by at least two competent witnesses who subscribe their names to the will in the presence of the testator.” NRS 133.040.

However, proving a lack of capacity after someone has passed on can be very difficult. If the person who executed the will lacked testamentary capacity because of dementia or Alzheimer’s, the will is not valid.

The person who executed the will must be over 18 years old and of sound mind.
